We have Twitter (X, or whatever it might be called by the time you read this), LinkedIn, Reddit threads, TikTok videos, you name it. And these platforms can spread information—and sometimes misinformation—in the blink of an eye.
Balancing the desire to disseminate timely market updates with the risk of unverified rumors is the ethical challenge here. If you quickly share an investment tip from a questionable source on Twitter, you could inadvertently mislead your audience. Or you might get involved in an online community that’s pumping and dumping penny stocks. In a worst-case scenario, sharing or endorsing false or incomplete information could trigger a market manipulation charge under Standard II.
Firms would do well to adopt or update social media policies that:
• Outline guidelines for official firm accounts and disclaimers on personal accounts.
• Mandate the use of disclaimers for any investment recommendations made online.
• Require employees to separate personal opinions from firm-endorsed statements clearly.
• Emphasize that the duty to maintain client confidentiality extends to social media posts, even casual references.
In my own experience, I once nearly tweeted a snippet of a client meeting that had an interesting takeaway—only to realize the comment was borderline confidential. Thank goodness I paused before hitting send. The bottom line is: think carefully about whether your post might breach the confidentiality or fairness obligations outlined in the Code and Standards.
Traditional compliance frameworks were not always designed with real-time big data or AI-driven analytics in mind. That means you should expect—and push for—frequent policy updates and specialized training to keep pace. For instance:

The firm also invests in better data integration and hires an AI ethics specialist. Meanwhile, the compliance function updates the risk scoring methodology and includes an independent review process. From an exam perspective, you’d likely be asked to apply Standards I, III, and possibly IV (Duties to Employers) if employees spot the error but aren’t sure how to address it without risking their jobs.

• Weak or Nonexistent Data Governance: Collecting massive datasets without robust privacy architectures or usage guidelines.
• Lack of Diversity in Training Data: Leading to biases that disproportionately affect certain client segments.
• Shallow Social Media Policies: Not having clear guidelines for personal vs. firm communication.
• Ignoring Soft Signals: Employees might sense that an algorithm is “acting weird,” but no formal mechanism exists to escalate concerns.

When exam day comes around, you might see item-set or constructed-response questions that present a scenario involving data mishandling, questionable AI-driven advice, or suspicious social media behavior by a colleague. Be prepared to:
• Identify the relevant standard (maybe Standard III on confidentiality or Standard II on market manipulation).
• Discuss the specific action you’d take to rectify the situation (e.g., halting the model, alerting compliance, providing transparency to the client, etc.).
• Evaluate the ethical dimension beyond mere legal compliance: “Is this in line with the fundamental principles of honesty, integrity, and client-first?”
Time management is also critical. Many of these scenario-based questions can get pretty intricate; break them down systematically. Answering ethically-focused items often means clarifying the big picture—who’s harmed, what is the professional’s duty, and how do we fix it or prevent it from happening again?
Ultimately, the Code and Standards might not explicitly mention microseconds or machine learning, but the underlying values are timeless. The forms of data and technology may change; the obligation to uphold professional integrity does not.
